      this agreement of lease is made on this 16th day of december XX by and between
      mrs ghazala waheed wo abdul waheed adult ro house no**** dha lahore cantt (hereinafter to as the lessor of the one part)
      and
      mr* ***ro china refereed to as the lessee of the other part(expression lessor
      and lessee wherever the context so permit shall always mean and include their respective heirs successors legal representative and assignees)
      whereas the lessor is the lawful owner and in lawful possession of house no****dha
      lahore cantt consisting of 4 bedrooms with bath ddtv lounge kitchen store servant quarter together with fixtures and fitting (hereinafter collectively called the demised premises)
      and whereas the lessor has agreed the lease and the lessee has agreed to take on lease the demised premises on the terms and condition as given below
      1 this agreement in only valid if lessee is renewed and extended for the lease period
      2 the lessor lets lessee takes the demissed premises for a period of 12 months
      commencing from 15th january XX the lease is renewable for a further period as may be mutually agreed in writing on expiry of the lease period
      3 the rent of the demised premises shall be usd3300(us dollars three thousand and three hundred only) per month
      4 the lessor hereby acknowledges receipt of the sum of usd19800(us dollars nineteen thousand and eight hundred only) per month
      5 it is hereby agreed between the parties that the lessee shall pay the aforesaid monthly rent
      usd 3300(us dollars three thousand and three hundred only) as the monthly rental advance by 20th of each calendar month for which if is due after completion of advance rent period ending on 15th july XX
      6 that the lessor hereby acknowledges receipt of the sum of rs60000(rupees sixty thousand only) from the lessee as fixed edposit security which shall be refunded to the lessee on giving back the vacant possession of the demised premises after deduction of damagesshortages outstanding bills for electricity water gas and telephone charges etc against the demised premises
      the lessee herby convenants with lessor as following
      1 to pay to the lessor the rent hereby reserved in the manner before mentioned
      2 that the lessee shall not at any time during the terms without the consent in writing of the lessor pull down damages or make any structure alterations to the demised premeses provided always the lessee shall have go write install any fixtures and fittings excluding airconditioners in the demised premeses to detach and repossess the same subject to the restoration of the demised premeses to their original state at his cost (reasonable wear and tear excepted) on the expiry of this lease or any renewal hereof
      3 to use the demises premises for residen
      tial purpose and would not be used for a commercial purpose the demises premise would not be used occupied by mr ****

      4 not to sublet the whole or any part of the premises
      5 to pay regularly the bills for electricity gas water and telephone charges in respect of the demised premises a copy of all the paid utility bill be forwarded to the lessor every three month regularly in case of disconnection of any facility due to nonpayment lessee will be responsible to get them restored and pay the same all dues must be cleared before the expiry of the lease
      6 the lessee shall keep and maintain the said premises in good and tenantable conditions during the tenure of the lease
      the lessor hereby convenants with the lessee as following
      1 to pay all existing and future rate taxes assessments and other charges of a public nature whether impose by the municipality government or any other authority in respect of demised premises
      2 not to erect or set up a building or structure on the demises premises nor to add to any existing building or structure during the period of lease or any renewal without the written consent of the lessee
      it is hereby declear and muturally agreed between the lessor and lessee ans follwing
      1 the lessee and the lessor shall have the right and option to terminate this lease at any time only after the expiry of the lease period ie 24 months provided they give one (1) month notice in advance to either of the parties

      51 interest rate of loan the interest rate under this contract is specified in 365 in line with relevant rules in case of change of interest rate the interest rate stipulated in the contract shall prevail for loans with a life of less than or equal to one year for loans with a life exceeding one year the interest shall be calculated on a multistage basis ie from next jan 1st following the adjustment of interest rate the new rate shall prevail in case the borrower fails to repay the principal and interest before the due date or fails to use the loan for purposes as agreed in this contract the lender shall be entitled to collect default interest in line with relevant rules the default interest rate is specified in 366

      61 the borrower should open an account with the lender( the account name and account number are specified in 367) and promise to deposit sufficient money for repayment before each due date the borrower hereby authorizes the lender to collect if any compound interest default interest liquidated damage premium compensation and expenses arising from the realization of creditor’s right (including lawyer’s fee and court expense)in addition to due principal and interest of loan in case the asset in this account is not enough for repayment of due principal and interest the lender shall be entitled to collect from any account opened by the borrower with any branch of icbc

      if party b does not submit an application for renewal two months prior to the expiration of this lease agreement or if party b submits such application but the parties fail to reach agreement on the renewal party a shall have the right to enter the premises with other tenant at work hours to review

      126 乙方营活动中宣称令顾客误认甲方关系属合作合营合伙联营关联企业关系
      party b shall not represent or otherwise mislead the customers that it has any cooperation joint operation partnership or affiliation relation with party a during its operation
      127乙方应行获取法律法规政府关部门规定应具备许批准证保证营业活动合法性
      party b shall be responsible for obtaining all approvals consents and licenses required by laws to ensure that its operation is legal
      128乙方应行承担乙方工商注册税务登记迁址等行产生税费
      party b shall be responsible for any and all taxes fees and expenses incurred for its industrial and taxation registrations and moving into the premises
      129第三方乙方造成房屋发生身伤害济损失提出索赔乙方应行负责保证甲方免类索赔甲方类索赔遭受损失乙方保证进行赔偿
      party b shall be responsible for and hold party a harmless against any claims raised by the customers for any personal injury and economic losses caused to the customers by party b or caused in the premises party b hereby warranties that it shall indemnity party a for any losses caused to party a by such claims
      1210乙方房屋放置易燃易爆物品危险物品
      party b shall not keep or store in the premises any flammable or explosive substances or other dangerous substances
      1211乙方应严格遵守甲方厦物业理机构制定时修改厦理规定
      party b shall strictly comply with all rules made and amended from time to time by party andor the management department
      1212 乙方房屋事违法活动
      party b shall not carry out any illegal activity in the premises
      1213乙方房屋办公外途
      party b shall not use the premises for any purpose other than as office
      1214乙方租赁房屋作公司注册址时乙方应租赁合终止15日办理址注销登记手续乙方逾期办理应日月租金千分三标准甲方支付滞纳金造成甲方损失应予赔偿
      if the premises is used as companys registered address of party b party b shall complete the procedures of writing off the registered address within 15 days after termination of the contract if party b is not able to complete the procedures on time it shall pay party a a penalty equal to 3‰ of the monthly rent per day of delay party b shall compensate for such loss

      this lease agreement will be terminated under any of the following conditions:

      1322 方违反合中规定方书面通知求予纠正三十(30)日未纠正违约行者果该违约法纠正守约方权立终止合
      by one of the parties with immediate effect when the other party is in breach of this lease agreement and such breach is not curable or is not remedied within thirty (30) days after the party not in breach sends a written notice requesting the cure of such breach
      1323甲方提前六十(60)天书面通知提前终止合应双倍返乙方保证金

      if party b delays the payment of rent andor other amounts for ten (10) days party a shall have the right to terminate this lease agreement and the deposit shall not be refunded party b shall pay a default penalty for the overdue amount at the rate of 05 of the overdue amount per day until it pays in full amount in addition to pay all the overdue amounts
      1325 乙方遵守厦理规定严重影响租户正常营甲方书面通知乙方提前终止合保证金予返
      if party b does not comply with the management rules of the building and therefore seriously affects the normal operation of other tenants party a may terminate this lease agreement in advance with a written notice and the deposit shall not be refunded
      1326 乙方房屋事违法活动未办公途房屋甲方权立书面通知乙方提前终止合保证金予返
      if party b carries out any illegal activity in the premises or use the premises for other purpose than office party a shall have the right to immediately terminate this lease agreement with a written notice and the deposit shall not be refunded
      1327 乙方房屋分租转租第三方甲方权书面通知立终止合保证金返
      if party b sublets or assigns the lease to a third party party a shall have the right to immediately terminate this lease agreement with a written notice and the deposit shall not be refunded
      1328 抗力force majeure
      方抗力事件连续六十天(60)履行义务方书面通知终止合抗力影响范围受影响方承担违约责抗力包括然灾害爆炸飞行物体坠落政府行(专门针受影响方行政行外)等受影响方预见控制避免事件双方明确商业性风险应作抗力受影响方应抗力事件发生五(5)日书面通知方应附权机构出具抗力发生证明
      either party may terminate this lease agreement with a written notice if one party is not able to perform its obligations hereunder for consecutive sixty (60) days due to force majeure the affected party shall not bear the liability of breach of contract to the extent of the effect of the force majeure force majeure shall include such events that the affected party is not able to foresee control and avoid as natural disaster explosive falling of flying objects government action (except those specially against the affected party) the parties hereby confirm that commercial risk shall not be deemed force majeure the affected party shall notify the other party in writing of such force majeure event accompanying with the certification of the occurrence of the force majeure event issued by competent authority

      one party may terminate this lease agreement if the other party launches the bankruptcy liquidation winding up or any similar procedure other than for the purpose of a bona fide reconstruction or amalgamation
      13 3 合终止果 the result of the termination
      1331 合届满未乙方续租乙方须届满日17点前腾空房屋合原提前终止乙方应终止日三日腾空房屋乙方未期间腾空房屋乙方应日支付房租逾期十日(包括十日)乙方应双倍房租支付甲方造成济损失(包括未租户时交付房屋导致违约金租金收入)应赔偿损失
      if this lease agreement is expired without the renewal of party b party b shall vacant the premises by 5pm on the date of expiration if this lease agreement is terminated in advance for whatever reason party b shall vacant the premises within three (3) days after the termination date if party b fails to vacant the premises within the aforesaid period it shall pay rent for each day of delay if the delay is over ten (10) day (inclusive) party b shall pay the rent in double amount if there is any economic loss caused to party a including the penalty for not delivering the premises to next tenant on time and rent loss party b shall compensate such loss
      1332乙方应拆装修清理房屋(甲方意保留装修外)甲方交付时状态双方认状态房屋交甲方(正常损耗外)房屋时留房屋设施装修物品均视乙方放弃权甲方意处置乙方未房屋恢复原状甲方行恢复原状乙方需支付全部费甲方保证金中扣
      party b shall also dismantle the decoration (except for the decoration that party a agrees to retain)and clean the premises so that the premises will be returned to party a in the same condition as when delivered to party b or (fair tear and wear is excepted) party b shall be deemed waiving the title of all facilities decoration and staff left the premises when the premises is returned to party a and party a may dispose them in any way if party b fails to restore the premises to the condition of delivery party a may restore the premises to the condition of delivery and party b shall bear all expenses thereof which may be deducted from the deposit by party a
      1333乙方违约造成合终止情况合规定情况外甲方应保证金返乙方
      party a shall refund the deposit to party b except the termination is caused by the breach of party b and otherwise provided hereunder
      1334 乙方应支付全部应付费包括房租水电费电话费等
      party b shall pay in full amount all the due payment including rent water and electricity fee and telephone call charge
      1335 双方应列程序进行交接房屋
      the parties shall take over the premises in accordance with the following procedure

    权争议提交北京仲裁委员会仲裁裁决仲裁程序应遵仲裁委员会现行仲裁规进行仲裁期间双方应继续执行合涉争议部分
      any disputes arising from the execution of or in connection with this lease agreement shall be settled through friendly consultations between the parties in case no settlement can be reached through consultations such dispute shall be submitted to beijing arbitration committee in accordance with its rules during the arbitration the parties shall continue to perform the part of this lease agreement not under dispute
      142 合修改the amendment of this lease agreement

      the invalidity of any part of this lease agreement shall not affect the validity of other clauses

      this lease agreement constitutes the entire contract between the parties with respect to the subject matter of this lease agreement and supersedes all prior understandings between them on such subject matter

      方根合发出通知联系应中文书写应通专送递挂号邮寄公认快递服务传真(应发送成功报告)发送方述址通知视效送达日期方法予确定:
      any notice provided for in this lease agreement shall be in chinese and shall be delivered by person or sent by prepaid registered mail or courier or sent by facsimile with the confirmation of successful transmission by the fax machine transmitted or addressed to the appropriate partys following address the notice shall be deemed served on the following date:

      on 10th day after stamp on the registered mail if send by registered mail
      1463快递送达通知视公认快递服务机构发出第三(3)天送达on third day after the pick up by the courier if send by courier
      1464 传真发送知应视作发送日(1)营业日送达
      if send by facsimile on the next working day after the transmission date
      1465方更改址需提前三十(30) 天书面通知方该更改方生效
      if either party wishes to change the above addresses it shall notify the other party of such change thirty (30) days in advance in order that such change will be effective
