141theshippingspaceforthecontractedgoodsshall be booked by thebuyerorthebuyer＇sshippingagent__________
142 under fob terms the seller shall undertake to load the
contractedgoodsonboardthevesselnominatedbythebuyer on any date
notifiedbythebuyerwithinthetimeofshipmentasstipulatedinclause

143underfasterms the seller shall undertake to deliver the
contractedgoodsunderthetackleofthevesselnominatedbythebuyer on
anydatenotifiedbythebuyerwithinthetimeofshipmentas stipulated

1441015dayspriortothedateofshipmentthebuyershall inform
thesellerbycableortelexofthecontractnumbernameof vessel eta
ofvesselquantitytobeloadedandthenameofshippingagentsoas to
enablethesellertocontacttheshippingagent direct and arrange the
shipmentofthegoodsthesellershalladvisebycableor telex in time
thebuyeroftheresultthereofshouldforcertain reasons it become
necessaryforthebuyertoreplacethenamedvesselwithanother one or
shouldthenamedvesselarriveattheportofshipment earlier or later
thanthedateofarrivalaspreviouslynotifiedtotheseller the buyer
oritsshippingagentshalladvisethesellertothiseffectindue time
thesellershallalsokeepinclosecontactwiththeagentorthebuyer
145shouldthesellerfailtoloadthegoodsonboardor to deliver
thegoodsunderthetackleofthevesselbookedbythebuyer within the
timeasnotifiedbythebuyerafteritsarrivalattheport of shipment
thesellershallbefullyliabletothe buyer and responsible for all
lossesandexpensessuchasdeadfreightdemurrageconsequential losses
incurreduponandorsufferedbythebuyer
146shouldthevesselbewithdrawnorreplacedordelayed eventua lly
orthecargobeshutoutetcandthesellerbenotinformedingoodtime
tostopdeliveryofthecargothecalculation of the loss in storage
expensesandinsurancepremiumthussustainedattheloadingportshallbe
basedontheloadingdatenotifiedbytheagenttotheseller(orbasedon
thedateofthearrivalofthecargoattheloadingportincasethecargo
should arrive there later than the notified loading date) the
abovementionedlosstobecalculatedfromthe16thdayafterexpiryofthe
freestoragetimeattheportshould be borne by the buyer with the
exceptionofforcemajeurehoweverthesellershallstill undertake to

loadingportatitsownriskandexpensesthepaymentof the aforesaid

loadingtochinaporttranshipmentonrouteisnot allowed without the
buyer＇spriorconsentthegoodsshallnotbecarried by vessels flying
flagsofcountriesnotacceptabletotheportauthoritiesofchina
152thecarryingvesselcharteredbytheseller shall be seaworthy
andcargoworthy the seller shall be obliged to act prudently and
conscientiouslywhenselectingthevesselandthecarrierwhen chartering
suchvesselthebuyerisjustifiedinnotacceptingvesselschartered by
thesellerthatarenotmembersofthepiclub
153thecarryingvesselcharteredbythesellershallsailandarrive
attheportofdestinationwithinthe normal and reasonable period of
timeanyunreasonableaviationordelayisnotallowed
154theageofthecarryingvesselcharteredbythesellershall not
exceed15yearsincaseherage exceeds 15 years the extra average
insurancepremiumthusincurredshallbebornebythesellervessel over
20yearsofageshallinnoeventbeacceptabletothebuyer
155forcargolotsover1000mteachoranyotherlots less than
1000metrictonsbutidentifiedbythebuyerthesellershallat least
10dayspriortothedateofshipmentinformthebuyerbytelexor cable
ofthefollowinginformationthecontractnumberthenameof commodity
quantitythenameofthe carrying vessel the age nationality and
particularsofthecarryingvesselthe expected date of loading the
expectedtimeofarrivalattheportofdestinationthename telex and
cableaddressofthecarrier

destinationbytelexorcableaboutitseta(expectedtime of arrival)

157ifgoodsaretobeshippedperlinervesselunderliner bill of
ladingthecarryingvesselmustbeclassifiedasthehighest____________
orequivalentclassaspertheinstituteclassificationclause and shall
besomaintainedthroughoutthedurationoftherelevantbill of lading
neverthelessthemaximumageofthevesselshallnotexceed20 years at
thedateofloadingthesellershallbeartheaverage insurance premium
forlinervesselolderthan20yearsundernocircumstances shall the
buyeracceptvesselover25year sofage
158forbreakbulkcargoesifgoodsareshippedincontainersbythe
sellerwithoutpriorconsentofthebuyera compensation of a certain
amounttobeagreeduponbybothpartiesshallbepayabletothebuyer by
theseller
159thesellershallmaintainclosecontactwiththecarrying vessel
andshallnotifythebuyerbyfastestmeansofcommunicationaboutanyand
allaccidentsthatmayoccurwhilethecarryingvesselis on route the
sellershallassumefullresponsibilityandshallcompensatethebuyerfor
alllossesincurredforitsfailuretogivetimelyadviceor notification
tothebuyer
