对刑法认识错误的理解与运用


    刑法中认识错误理解运
     
    刑法中认识错误行行法律意义者关客观事实存正确认识种认识错误关系行刑事责追究问题更应该值认真刑法中认识错误原分两种情况:行法律身认识错误二行事实认识错误
    行法律身认识错误
    行法律身认识错误行意识实施某种行时行法律性质意义产生正确认识类认识错误通常包括三种情况:
    1罪误认罪
    种情况行行法律规定构成犯罪行误认构成犯罪例:行辱骂张三某天外出会车撞死张三天外出时正遭遇起交通事死亡行知张三天外出交通事死亡消息认辱骂张三行导致张三死亡构成犯罪公安机关投案首国刑法没种行规定犯罪种认识错误法律影响该行认定罪
    2罪误认罪
    种情况行行法律规定已构成犯罪行误认构成犯罪例:行盗取财物刚出门感觉害怕悔立返回财物放回原处离开行认构成犯罪国刑法种行认定盗窃犯罪心理素已盗取财物返回行作法院量刑环节处理刑事违法性犯罪意认识容行种认识错误影响犯罪成立

    行事实认识错误指行行关事实情况产生正确认识类认识错误否影响行刑事责区情况具体:果行认识错误属犯罪构成件方面事实情况影响行刑事责果行认识错误属犯罪构成件外事实情况影响行刑事责行事实认识错误分种情况:
    1行客体方面认识错误
    谓行客体方面认识错误指行危害行侵犯社会关系性质产生正确认识例:某甲意图伤害某乙未认识某乙国家工作员时正执行公务某甲行客观妨害公务行某甲认识行侵害身健康权利未认识妨害公务罪客体行意图侵害社会关系意具伤害意妨害公务具意客体错误种情况排行超出认识范围实际结果意果行意实施某种危害社会行时已认识行时侵害社会关系便属客体错误客体错误表现行行实际侵害社会关系误解果认识实际侵害客体便属错误范畴
    2行象认识错误
    (1)某甲象误认某乙象该两者体现合法权益相行欲绑架张三手细心绑架李四种认识错误影响行定性意认识素行危害性质危害结果认识危害结果行合法权益实施具体侵害具体象然两者体现合法权益性质相时行侵犯合法权益性质没改变罪容没改变该行应认定犯罪遂
    (2)某甲象误认某乙象两者体现合法权益相 行欲盗窃般财物结果枪支成般财物盗回种认识错误应结合行观客观方面实际情况进行定性种认识错误超出犯罪构成范围行认识事实现实发生事实分属犯罪构成件称犯罪间错误种认识错误应客观统范围认定犯罪根行意容者行客观容认定犯罪应意容客观行相统范围认定犯罪
    (3)非犯罪象作犯罪象加侵害行误兽加杀害行甲乙仇某天夜晚甲欲杀害乙便带枪乙居住木屋前窥探甲听木屋动静便乙家枪通窗户木屋连开数枪结果天晚甲家乙饲养两狗争抢食物种情况般应意犯罪未遂定性果客观行情况没发生危害结果性应实际出发行认定罪
    (4)犯罪象作非犯罪象加侵害误兽李某晚外出山兔结果坐树底谈恋爱男青年死种情况行观没认识行会发生危害社会结果认定意犯罪果行应预见疏忽意没预见应认定失犯罪
    应承担失犯罪刑事责果预见应预见意外事件承担刑事责 
    3行认识错误
    (1)行性质认识错误指行行性质产生正确理解假想防卫假想避险等天傍晚林某回学校途中发现两男青年追逐挑逗校女学林某前进行制止期间遭中青年殴迫手两程中穿着便衣学校换岗保安辛某路辛某见状顾着亮明身份前拉住林某林某误认辛某帮凶便出身刚买型水果刀辛某胸部刺刀逃跑闻讯群众民警林某抓获案中林某行性质观产生认识错误非侵害行成侵害行形成假想防卫种情形认定意犯罪果行存失认定失犯罪没失认定罪
    (2)行方法认识错误指行手段否发生危害结果存正确理解包括三种情况:行手段会发生危害结果行误认会发生危害结果行误毒酒作药酒予饮致死亡种情况失定失犯罪失认定罪二欲会发生危害结果手段行误白糖作砒霜意图毒死种情况应认定犯罪未遂发生危险情况否定罪值研究三行手段导致危害结果发生行误认导致危害结果发生例行采取诅咒划符等手段杀行种情况属迷信行导致危害结果发生应认定犯罪
    4果关系认识错误
    谓果关系认识错误指行危害社会行危害结果间果联系
    产生正确认识方面认识错误现实生活中分种情况:
    (1)果容错误:实际结果行预想结果例行意图杀实际造成伤害种错误影响行意心理刑事责认定未遂二实际结果行预想结果例行想伤害结果造成死亡种错误影响行原意心理实际发生超出意范围结果排意应负失责
    (2)果联系错误:行误认行已产生预期犯罪结果事实没发生种结果例甲开枪杀乙见乙倒乙已死亡实乙倒未死发现送医院救活甲应负意杀未遂责二行误认预期结果行引起实际行外原造成甲乙仇某日晚趁乙外出开枪击中乙乙昏迷甲乙已死逃走实际乙未死苏醒爬公路高速行驶汽车压死甲乙死亡结果付意杀未遂责
    (3)果进程错误:行果容明白误果关系进程产生歪曲反映甲欲淹死乙推乙河中结果乙非水淹死撞河中石头死亡种果关系进程认识属犯罪意容行应负意杀遂责
    5体身份认识错误
    种认识错误指行否具备成立某种犯罪法定身份存正确认识分两种情况:行具某种法定特殊身份行误认具法定特殊身份邮政部门时清洁工认邮政工作员私开拆隐匿者毁弃邮件行具备邮政工作员特殊身份成立刑法第253条规定邮政工作员体私拆隐匿毁弃邮件电报罪认定第252条规定侵犯通信罪二具法定特殊身份误认具法定特殊身份实施特定行问题涉意犯罪认识容否包括体身情况认识问题果认意成立求认识身情况述认识错误影响定罪
    果认意成立求认识身情况述认识错误影响定罪例行患严重疾病误认没患疾病实施卖淫者嫖娼行种情况然行客观行符合刑法第360条规定犯罪构成客观件行没认识行危害性质危害结果具该罪观件成立犯罪
    6击错误
    击错误通常情况行误差指行侵害行失误致实际侵害象行意图侵害象相符合例甲枪击乙枪法乙附丙击毙甲楼扔石头想炸毁乙汽车刚住楼丙窗口探头外张丙头部击成重伤情况行观认识错误关纯属客观行失误行误差实质言属刑法认识错误范畴够实际工作中正确理解运刑法认识错误作简述
